Castle Doctrine - House Bill 40
Help give law-abiding Pennsylvanians the right to defend their families and property in the face of physical threat.
The PA House Judiciary Committee held an informational hearing on Rep Perry's HB 40, the Castle Doctrine Bill, back on Nov 19, 2009, but no action taken. The bill would protect a gun-owners' right to stand your ground in the face of imminent physical threat. It removes the duty to retreat on your own land or in your own car, or on the property of someone else who wants you there, or on the street if threatened. Current law imposes a duty to retreat into your house if, in the armchair judgement of the court, it could have been done safely. In your car or on the street, you have to retreat in all circumstances, and the perp must actually physically attack you before you can respond with lethal force. The bill has 113 co-sponsors in the House out of 102 total members, but only 13 of the 26 members on the Judiciary committee where it is currently stalled. I just checked the committee schedule for February and the bill is not on the schedule. We need to flood the offices of the members of committee who aren't co-sponsors with calls letting them know Pennsylvania's armed citizens demand the right to protect themselves with no duty to retreat.

Here are the committee members and whether they've co-sponsored the bill.

If there are 102 total members, how can there be 113 co-sponsors?

I asked the same thing, it's why I counted the names listed on the state house website.

OK, here is a link to the proposed legislation (HB 40). Don't ask me to count names, since I am not going to. However; I agree with the other PAOC members, if you're going to post items on this forum try to be accurate and less confusing.

I can't believe you guys counted names. Way too much time on your hands. Tongue
